Terms & Conditions
These Terms and Conditions govern the relationship between Fun In The Box Entertainment and any individual, business, organization, or entity (referred to as "the client") that books, uses, or interacts with our services.
If you do not agree with any part of these Terms and Conditions, you must not use our website or book our services. Please read this document carefully before proceeding with any booking or payment.
These Terms and Conditions apply to all services offered by Fun In The Box Entertainment, including but not limited to mascot appearances, cotton candy experiences, foam parties, balloon modeling, face painting, photo booths, and any other entertainment services we provide.
Fun In The Box Entertainment is an event entertainment company based in Ohio that provides a wide range of interactive entertainment services for parties, schools, corporate events, festivals, community events, and private celebrations.
Our Services Include
- Mascot character appearances and experiences
- Cotton candy service and stations
- Foam party experiences
- Balloon modeling and sculpting
- Face painting
- Photo booth experiences
- Interactive entertainment activities
- Custom add-ons and branded experiences
- Any other entertainment services listed on our website or offered through a booking quote
Service Availability
All services are subject to availability based on date, location, staffing, and equipment. Not all services are available in all service areas. Availability is confirmed only upon receipt of a deposit and written booking confirmation from Fun In The Box Entertainment.
Service Descriptions
We make every reasonable effort to accurately describe our services on our website and in booking communications. However, Fun In The Box Entertainment reserves the right to make minor adjustments to service delivery as needed while maintaining the spirit and quality of the experience booked.
Deposit Policy
Once a deposit is received, Fun In The Box Entertainment begins reserving equipment, blocking scheduling, and allocating team members for your event. For this reason, deposits are non-refundable under all circumstances. However, deposits are transferable to a rescheduled date within six months, subject to availability.
Remaining Balance
The remaining balance is due no later than 48 hours before your scheduled event. If the remaining balance has not been received by this deadline, full payment must be completed before setup begins on the day of the event. Fun In The Box Entertainment reserves the right to delay setup and services until full payment is received.

Overtime
Overtime beyond the booked service time may be available depending on scheduling and availability. Overtime is charged in prorated 30-minute increments at the applicable rate. All overtime must be approved by Fun In The Box Entertainment and paid before the additional time begins. Overtime is not guaranteed and is subject to staff and scheduling availability.
Additional Services
If additional services, time extensions, or add-ons are requested after the initial booking, the deposit and total balance may be adjusted accordingly. Updated invoices will be provided for any additions.
Client Cancellation
If the client cancels the event for any reason, the deposit will be forfeited. No refunds will be issued for the deposit or any other payments made at the time of cancellation. If the remaining balance has not yet been paid, the client may still be responsible for a portion of the total booking amount depending on the timing of the cancellation.
Rescheduling
Clients may reschedule their event one time at no additional rescheduling fee. The deposit will be transferred to the new date. The following conditions apply to rescheduling:
- The new event date must be within six months of the original event date
- The new date must be available and agreed upon by both parties
- Rescheduling requests must be submitted in writing as soon as possible before the original event date
- If the new date is unavailable and no mutually agreeable date is found within six months, the deposit will be forfeited
- Only one complimentary rescheduling is offered β subsequent rescheduling requests may be subject to an additional fee
Same Day Cancellations
Same day cancellations by the client do not qualify for any refund. If the remaining balance has not been paid, full payment may still be required depending on the circumstances and timing of the cancellation.
Company Cancellation
In the rare event that Fun In The Box Entertainment must cancel due to unforeseen circumstances β including but not limited to severe weather, equipment failure, illness, or emergency β the client will be offered the choice to reschedule at no additional cost or to receive a full refund of all payments made. This is the only circumstance under which a full refund will be issued.
Many of our services β particularly foam parties and outdoor entertainment experiences β are weather-dependent. We take the safety of our guests, performers, and equipment seriously when making weather-related decisions.
Weather-Related Service Decisions
Fun In The Box Entertainment reserves the right to make the final determination regarding whether weather conditions are safe enough for services to proceed. Factors we consider include lightning, severe storms, high winds, heavy rain, extreme heat, and other conditions that may pose a safety risk.
Light rain alone may not prevent services from proceeding, particularly for indoor or covered events. Each situation is evaluated on a case-by-case basis.
Indoor Backup Location
For outdoor events, clients are strongly encouraged to have an indoor or covered backup location available. If an indoor option is available and suitable for the booked services, we will make every effort to proceed with the event as planned. If no backup is available and weather prevents services from proceeding safely, rescheduling policies will apply.
Weather Cancellations β No Refunds
Client-Initiated Weather Cancellations
If the client chooses to cancel the event due to weather β even in cases where Fun In The Box Entertainment would have been willing to proceed β the standard cancellation policy applies. The deposit will be forfeited or transferred according to the rescheduling terms above.
No Show or Inaccessible Location
If Fun In The Box Entertainment arrives at the event location and the client is not present, access is denied, or the location is not ready or safe for setup, no refund will be issued. The full booking amount remains due.
Fun In The Box Entertainment operates from two primary service locations in Ohio and serves events throughout Northeast Ohio and Southeast Ohio.
Northeast Ohio Service Area
Our Northeast Ohio operations are based near ZIP code 44128. We serve events within approximately 25 miles of this location, covering the greater Cleveland metropolitan area and surrounding communities including Beachwood, Shaker Heights, Parma, Strongsville, Westlake, Lakewood, Euclid, Mentor, Willoughby, Bedford, Independence, Akron, and many others. A full list of served communities is available on our website.
Southeast Ohio Service Area
Our Southeast Ohio operations serve events within approximately 25 miles of ZIP code 45701 in the Athens area, including Athens, The Plains, Albany, Nelsonville, Logan, Lancaster, and surrounding communities. Please note that not all services are available in the Athens service area β availability depends on equipment location, staffing, and scheduling. Contact us to confirm which services are available for your area.
Travel Outside Standard Service Areas
We regularly travel beyond our standard service areas for events of sufficient size or when scheduling allows. Events located outside our 25-mile service radius are subject to an additional travel fee calculated at $2.00 per mile, round trip, from the nearest service location.
Travel fees are calculated and communicated clearly before booking confirmation. Clients are responsible for providing accurate event location information. If the actual event location differs from the address provided at booking, additional travel charges may apply.
Areas Not Listed
If your city or community is not listed in our service area, please contact us. We may still be able to accommodate your event depending on distance, availability, and the type of services requested.
The client is responsible for ensuring that a proper setup environment is available for all booked services. Failure to provide appropriate conditions may result in delayed service, reduced service time, or cancellation without refund.
Setup Area
The client must provide a clear, level, and accessible setup area prior to our arrival. The area must be free of obstacles, debris, unsafe surfaces, and hazards. Fun In The Box Entertainment reserves the right to refuse setup in conditions deemed unsafe.
Access and Arrival
The client must ensure access to the event location before our scheduled arrival time. Delays caused by restricted access, lack of parking, or client unreadiness will reduce service time. Service end times are not adjusted for client-caused delays. Full payment remains due regardless of delays caused by client circumstances.
Power and Water
Certain services require a standard power outlet within a reasonable distance of the setup area. Foam party services require access to a functional garden hose water connection. If required utilities are not available, the affected service may not operate and no refund will be issued.
Venue Permissions
The client is solely responsible for obtaining all required permissions from venues, parks, schools, landlords, HOAs, or other property managers. This includes permission for foam, water, electrical use, sound, signage, and any other service requirements. Fun In The Box Entertainment is not responsible for service cancellations caused by lack of permissions. No refunds will be issued in such cases.
Parking and Access
Safe and reasonably accessible parking must be provided near the setup area. Any unusual access conditions β including stairs, long carry distances, elevators, or restricted entry β must be disclosed at the time of booking. Additional fees may apply if access conditions require extra labor or equipment.
Assumption of Risk
The client understands that entertainment services β including foam parties, mascot appearances, interactive activities, and all other services offered by Fun In The Box Entertainment β involve inherent risks. These risks may include slips, falls, collisions, contact with equipment, wet surfaces, uneven terrain, and participant behavior. The client accepts all known and unknown risks associated with participation in these services.
Client Responsibility for Guests
The client is fully responsible for the behavior and supervision of all participants, children, and attendees at the event. Fun In The Box Entertainment staff do not provide crowd control or guest supervision unless explicitly agreed upon in writing before the event.
Children must be supervised by responsible adults at all times. The client must ensure all guests follow safety instructions provided by our team. Unsafe behavior β including running, pushing, rough play, or misuse of equipment β may result in services being paused or terminated without refund.
Foam and Wet Surface Risk
Foam services create wet and slippery conditions. Participants engage in foam activities at their own risk. Fun In The Box Entertainment is not responsible for slips, falls, or injuries resulting from wet surfaces or foam residue. The client is responsible for informing guests of these conditions.
Equipment β Authorized Use Only
Only Fun In The Box Entertainment staff are authorized to operate, adjust, or handle our equipment. Guests, children, venue staff, and third parties are not permitted to touch, operate, move, or interfere with equipment in any way. The client is responsible for preventing unauthorized use.
No Liability for Injuries or Damages
Fun In The Box Entertainment, its owners, employees, contractors, and representatives shall not be liable for any bodily injury, property damage, personal injury, or other loss arising from participation in or attendance at any event at which our services are provided.
Indemnification
The client agrees to defend, indemnify, and hold harmless Fun In The Box Entertainment and its team from any and all claims, liabilities, damages, expenses, or legal actions arising from the event, including claims related to participant injuries, property damage, or the actions of guests or third parties.
Scope of Responsibility
This responsibility applies to all equipment, costumes, props, accessories, supplies, and company property present at the event β regardless of whether the damage was caused by the client, guests, children, vendors, venue staff, pets, weather exposure, or any other person present.
Types of Damage Covered
The client is responsible for all forms of damage or loss, including physical damage, cosmetic damage, water damage, weather-related damage, electrical damage, theft, vandalism, tampering, misuse, rough handling, stains, excessive mess, missing parts, and any other condition that diminishes the value or functionality of the equipment.
Unauthorized Use
Only Fun In The Box Entertainment staff may operate, adjust, or handle our equipment. Any damage resulting from unauthorized use by guests or third parties is the full financial responsibility of the client.
Repair or Replacement Costs
Fun In The Box Entertainment will determine, at its sole discretion, whether damaged items will be repaired or replaced. The client agrees to pay the full cost of repair or replacement, including parts, labor, shipping, and any related administrative costs. Damage invoices are due upon receipt.
Missing or Stolen Items
Any company property that cannot be located after the event will be treated as damaged beyond repair and charged at full replacement value. The client is fully responsible for all missing items regardless of the circumstances.
Non-Refundable Situations
No refunds will be issued in any of the following circumstances:
- Client cancellation for any reason
- Weather-related cancellations (rescheduling credit only)
- Same-day cancellations
- Client no-show or inaccessible event location
- Client not ready β delays that reduce service time
- Early termination requested by the client
- Services stopped due to unsafe conditions or behavior
- Missing venue permissions or utilities
Deposits Are Always Non-Refundable
All deposits are non-refundable without exception. Once paid, the deposit represents a commitment by Fun In The Box Entertainment to reserve your date, equipment, and staff. Deposits may be transferred to a rescheduled date within six months under the rescheduling terms described in the Cancellation and Rescheduling section.
Partial Refunds
Fun In The Box Entertainment does not offer partial refunds. All bookings are treated as a single transaction β once services are confirmed and a deposit is paid, all payments are considered final.
The Only Exception β Company Cancellation
A full refund of all payments made will be issued only if Fun In The Box Entertainment initiates a cancellation and is unable to reschedule your event. This situation is rare and applies only to company-caused cancellations, not client-caused ones.
By booking services with Fun In The Box Entertainment, the client agrees to fulfill the following responsibilities. Failure to do so may result in delayed service, reduced service time, termination of services, or additional charges β all without refund.
Accurate Information
The client must provide accurate and complete event details at the time of booking, including event date, start time, location address, number of guests, and services requested. Any changes must be communicated in writing as soon as possible. Fun In The Box Entertainment is not responsible for issues caused by incorrect or incomplete information.
Guest Supervision
The client is responsible for supervising all guests, children, and participants throughout the event. Fun In The Box Entertainment staff do not provide crowd control unless specifically agreed upon in writing. The client must assist in enforcing all safety rules.
Setup Readiness
The setup area must be ready and accessible upon our arrival. All required utilities β power, water, and parking β must be available as needed for the selected services.
Venue Permissions
The client is solely responsible for obtaining all necessary permissions from property owners, venues, parks, and other authorities before the event. Fun In The Box Entertainment will not be responsible for any service disruptions caused by missing permissions.
Guest Conduct and Alcohol
The client is responsible for monitoring all guests, including those who may be under the influence of alcohol or substances. Disruptive or unsafe behavior by any guest may result in services being paused or terminated without refund. Fun In The Box Entertainment staff have the authority to stop services if guest behavior poses a safety concern.
Responsibility for Third Parties
The client is responsible for the conduct of all attendees, vendors, venue staff, and any other third parties present at the event. Fun In The Box Entertainment is not liable for actions taken by guests, vendors, or others attending or working at the event.
All content on the Fun In The Box Entertainment website, including but not limited to text, images, logos, graphics, videos, character names, service descriptions, branding elements, and design layouts, is the intellectual property of Fun In The Box Entertainment or its licensed content providers.
Generic Character Names
Fun In The Box Entertainment uses original generic names for all character appearances. All character names used on our website and in our marketing are original designations created for our entertainment services. We do not use or claim ownership of any trademarked character names, franchises, or intellectual property owned by other companies.
Website Content
You may not copy, reproduce, modify, distribute, or use any content from our website without prior written permission from Fun In The Box Entertainment. Unauthorized use of our branding, logos, or creative materials is prohibited.
Client-Provided Materials
When clients provide logos, photos, designs, or other materials for use in add-ons such as branded bags or custom signage, the client confirms they have the legal right to use and share those materials. Fun In The Box Entertainment is not responsible for any intellectual property claims arising from client-provided content.
Photos and Media
Photos and videos taken by Fun In The Box Entertainment at events remain the property of Fun In The Box Entertainment and may be used for marketing purposes as outlined in our Privacy Policy. Clients who wish to opt out of media use must submit a written request before the event.
Fun In The Box Entertainment reserves the right to refuse, pause, modify, or terminate services at any time, for any of the following reasons, without issuing a refund:
- Unsafe event conditions or setup environment
- Unsafe, abusive, or threatening behavior toward our staff or performers
- Guest behavior that poses a risk to participants or equipment
- Failure to meet setup requirements
- Failure to complete payment by the required deadline
- Misuse, tampering, or endangerment of company equipment
- Illegal activity occurring at or near the event
- Situations that compromise the safety of our team, equipment, or guests
- Harassment, discrimination, or hostile conduct toward our team
Safety Decisions Are Final
All decisions related to safety are made at the sole discretion of Fun In The Box Entertainment staff and are final. We prioritize the safety of our performers, equipment, and all event guests above all else.
No Refund for Terminated Services
Right to Decline Future Bookings
Fun In The Box Entertainment also reserves the right to decline future booking requests from clients who have previously violated these Terms and Conditions or created unsafe or hostile conditions at an event.
No Liability for Indirect Damages
Fun In The Box Entertainment shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of enjoyment, emotional distress, lost business opportunities, or reputational harm, whether or not we were advised of the possibility of such damages.
No Guarantee of Specific Outcomes
While we strive to deliver the highest quality entertainment experience at every event, Fun In The Box Entertainment does not guarantee any specific outcome, guest reaction, or entertainment result. We guarantee our professional effort and commitment to the services described in the booking agreement.
Force Majeure
Fun In The Box Entertainment is not liable for any failure to perform its obligations due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, government restrictions, power outages, illness, equipment failure, accidents, road closures, or other force majeure events. In such cases, rescheduling or refund options will be offered in accordance with our applicable policies.
Third-Party Actions
Fun In The Box Entertainment is not responsible for the actions, conduct, or omissions of any third party, including venue staff, other vendors, guests, or uninvited individuals who may be present at the event.
Maximum Liability
To the maximum extent permitted by applicable law, the total aggregate liability of Fun In The Box Entertainment β regardless of the theory of liability β shall not exceed the amount paid by the client for the specific service(s) at issue.
Governing Law
These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to our services or these Terms and Conditions shall be brought exclusively in the appropriate state or federal courts located in Ohio.
Dispute Resolution
Before initiating any legal action, the client agrees to first contact Fun In The Box Entertainment in writing at events@funintheboxent.com to attempt to resolve the dispute informally. Fun In The Box Entertainment will make a good-faith effort to address any legitimate concerns within 14 business days of receiving written notice of a dispute.
Waiver of Jury Trial
To the fullest extent permitted by applicable law, both parties waive any right to a jury trial in connection with any dispute arising under or related to these Terms and Conditions or our services.
Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible.
Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any specific booking confirmations or written agreements, constitute the entire agreement between Fun In The Box Entertainment and the client with respect to the services booked. No verbal statements, prior communications, or informal understandings shall supersede or modify these written terms.
Fun In The Box Entertainment reserves the right to update, modify, or replace any part of these Terms and Conditions at any time, at our sole discretion. We may make changes to reflect updates in our business practices, services offered, legal requirements, or operational procedures.
How We Notify You of Changes
- The "Effective Date" at the top of this page will be updated whenever changes are made
- For material changes that significantly affect client rights or obligations, we will make reasonable efforts to notify active clients by email or through a notice on our website
- Minor clarifications or corrections may be updated without separate notification
Your Continued Use Constitutes Acceptance
By continuing to use our website or booking our services after any updates to these Terms and Conditions, you acknowledge that you have read the updated terms and agree to be bound by them. It is your responsibility to review this page periodically to stay informed of any changes.
Bookings Made Under Previous Terms
For events booked and confirmed under a previous version of these Terms and Conditions, the terms in effect at the time of booking confirmation will generally apply to that specific booking, unless the client agrees in writing to the updated terms.
